Abstract
l presente contributo propone un inedito parallelismo tra le esigenze regolatorie del lobbying e quelle del nudging pubblico – insieme delle tecniche di persuasione impiegate dai pubblici poteri per realizzare l’interesse dei cittadini – ponendo l’accento sugli elementi comuni a entrambi. A tal fine, l’Autrice rileva come il principio di trasparenza e il valore della partecipazione ai processi decisionali assumano un ruolo centrale nella democrazia italiana. Così come centrale è la circolarità nel rapporto tra cittadini, gruppi di interesse, partiti politici e decisori, le cui azioni di governo e legislative sono rivolte, in definitiva, ai cittadini stessi. In ciò le basi del parallelismo proposto dall’Autrice.
The regulation of decision-making processes: from lobbying to nudging, two instruments in search of legislation
This contribution proposes an original parallelism between the regulatory requirements of lobbying and those of public nudging – a set of persuasion techniques employed by public authorities to realise the interests of citizens – emphasising the elements common to both. To this end, the Author notes how the principle of transparency and the value of participation in decision-making processes assume a central role in Italian democracy. Just as central is the circularity in the relationship between citizens, interest groups, political parties and decision-makers, whose governmental and legislative actions are ultimately addressed to the citizens themselves. This is the basis of the parallelism proposed by the Author.
