Abstract
Il ‘paesaggio’ di cui la Costituzione italiana sancisce sin dal 1948 la tutela è spesso stato interpretato dalla giurisprudenza come sinonimo di ‘ambiente’, creando un collegamento non sempre favorevole al primo. Il quadro giuridico è stato ulteriormente complicato per la ricerca degli adeguati strumenti giuridici per la gestione del bene – in senso ampio – che si intende tutelare, spesso fatti coincidere con quelli generalmente utilizzati per il ‘governo del territorio’ e che nel tempo hanno attratto la tutela paesaggistica nell’ambito dell’urbanistica. La prospettiva adottata dal presente studio è quella che vede il paesaggio abbinato a un valore diverso da quello ambientale, differenziato da quello prettamente territoriale, cui non vi si sovrappone ma che lo completa, cioè quello di ‘patrimonio storico e artistico della Nazione’, – vedi ancora l’art. 9 cost. –, evidenziando la dimensione culturale dell’intervento pubblico per la sua tutela, in armonia con la visione sovranazionale.
Landscape and Surroundings
The ‘landscape’- whose protection has been established by the Italian Constitution since 1948 – has often been interpreted by jurisprudence as synonymous with ‘environment’, creating a connection that is not always favorable to the former. The legal framework has been further complicated by the search for suitable legal instruments for the management of the asset – in the broad sense – that it is intended to protect, often made to coincide with those generally used for the ‘government of the territory’ and that over time have shifted landscape protection within the scope of urban planning. This study’s perspective sees the landscape as having a value other than the environmental one, differentiated from the purely territorial one, which does not overlap but which completes it: that of ‘historical and artistic heritage of the nation’, -see article 9 of the Constitution-, highlighting the cultural dimension of public intervention for its protection, in harmony with the supranational vision.
